Complex auto accident with traumatic brain injury

Recently, I resolved a complex auto accident with traumatic brain injury case in the United States District Court for the Eastern District of Arkansas. We secured a favorable outcome for my client. Navigating a complex auto accident with traumatic brain injury requires thorough investigation, strategic legal analysis, and the ability to advocate effectively for injured clients. This case demonstrated the importance of meticulous preparation and expert collaboration in establishing liability and the full impact of injuries.

The Case

Our client was lawfully slowing to enter an active construction zone when another vehicle failed to reduce speed, causing a rear-end. The impact caused our client’s vehicle to spin out of control and exit off the right shoulder. The client suffered a concussion and developed post-concussion syndrome, which significantly affected  daily life and the ability to work.

Building the Case

One key element of this case was obtaining and analyzing electronic GPS data from the defendant. This data provided critical insights into the defendant’s travel history on the day of the accident, including trip times and speed as contributing factors in the collision.

To build the strongest case possible, I worked with leading experts:

  • Neurology Expert: A specialist in Diffusion Tensor Imaging (DTI) and Susceptibility-Weighted Imaging (SWI) neuroimaging, who uses volumetric analysis to document the severity brain injury and cause of post-concussion symptoms.
  • Vocational Expert & Economist: These experts assessed how the injury affected my client’s ability to do past work, and the projected future financial losses.

The Outcome

Through extensive discovery, expert collaboration, and a comprehensive legal strategy, the complex auto accident with traumatic brain injury case was resolved before trial with a $725,000 settlement. The combination of medical evidence and economic analysis helped demonstrate the full impact of the client’s injuries, leading to a fair resolution.

Experience Matters

Personal injury cases, particularly those involving complex medical conditions like traumatic brain injuries, require an experienced attorney who understands how to navigate both legal and evidentiary challenges. Our attorneys have successfully handled cases in both state and federal courts throughout the Midwest, securing multiple multi-million-dollar settlements and judgments for clients who have suffered serious injuries.

It’s important to note that in Missouri, you only have a limited amount of time to file a personal injury lawsuit, so it’s important to act quickly if you’ve been injured by another’s failure to do what they agreed. An experienced  attorney can help you understand your options and guide you through the legal process.
