Firm Obtains $475,000 Settlement for Client Injured by Business’s Inaction
Kennedy, Kennedy, Robbins & Yarbro, LC, recently finalized a personal injury settlement that involved claims that a business failed to remove ice and snow from its customer parking area.
The client was walking across the parking area when she slipped on ice and snow causing her to fall. As a result of the fall, she sustained a femoral fracture that required surgical fixation using a femoral shaft nail.
Our personal injury lawyers brought claims against the business for its failure to do what it agreed to do in its commercial lease – remove ice and snow from its customer parking area. The business failed to inform its employees of this agreement, failed to provide tools for removal of ice and snow, and failed to secure a contractor to assure the parking area was cleaned after ice and snow accumulation. The business had a history of not performing agreements it had made, and the business’s inaction resulted in catastrophic injuries to our client, leading to the settlement.
Ordinarily, a business has no legal obligation to remove ice and snow. However, when a business agrees to do something, the law will hold that business responsible for injuries resulting from its non-performance. These suits often reach settlement before trial.
It’s important to note that in Missouri, you only have a limited amount of time to file a personal injury lawsuit, so it’s important to act quickly if you’ve been injured by another’s failure to do what they agreed. An experienced attorney can help you understand your options and guide you through the legal process.
