Will contest – confidential settlement

Chris Yarbro settled a complicated will contest action in Bollinger County. Chris represented a friend and care giver of an elderly couple, who they nominated to receive their entire estate through a will. The original will had been lost, requiring the existence of the will, and the specific bequest, to be first proved in strict form in probate court. After a bench trial, the probate court admitted the will as proven as the last will of the decedents. Immediately, the decedents’ family filed a contest action seeking a jury trial to undue the probate court’s ruling. The contestants refused to consider possible negotiations towards settlement, insisting on having a jury trial. On the morning of trial, the contestants agreed to settlement after losing key evidentiary motions which significantly limited their intended trial presentation.
